Legal-business auto accidents Term Paper Example | Topics and Well Written Essays - 1250 words

Legal-business auto accidents - Term Paper Example Honda Motor Company, â€Å"where the court ruled that the regulation foreclosed the filing of injury suits under the state law by the people contending that manufacturers had made the wrong choice† (Liptak). II. Facts of the Case: Petitioner, Alexis Geier, was driving a 1987 Honda Accord, which collided in a tree and caused the petitioner serious physical injuries, despite the fact that the shoulder and lap belts were fastened at the time the accident happened. The car was not also equipped with airbags. Petitioner, together with her parents, sued American Honda Motor Company, Inc. before the District of Columbia tort law, on the ground that Honda negligently was remiss in its obligation as a car manufacturer for failure to set an airbag at the driver’s side. The Court dismissed the case on the ground that it was the discretion of Honda to whether or not install an airbag in its car models. Hence, this ruling concluded that it was not mandatory for the automakers to ins tall a passenger-side airbag, and shall not be liable for a personal injury case based on such ground. The Court of Appeals reaffirmed the decision of the District Court which resulted to a dismissal of the case. Thus, an appeal to the Supreme Court was filed by the petitioners. ... s in conflict with the existing provisions of FMVS 208 Act, particularly on the express pre-emption provision Ruling: The Supreme Court ruled that: With regard to the first issue, the court held that the ordinary principles of pre-emption shall not apply in the case of the petitioners. The provision contained in the Act states that the federal safety standard does not relieve a person from any liability on the basis of the common law. Hence, the petitioners are not precluded from setting up a claim against American Honda. The language of the provision clause enacted by Congress does not prohibit common-law actions. The spirit of the law must be followed and not its literal meaning of the law. In case of doubt, the intention of the law must prevail over the strict context of the law. Thus, â€Å"express pre-emption provision that excludes common-law tort actions gives actual meaning to the saving clause’s literal language, while leaving adequate room for state tort law to oper ate† (Cornell). For the second issue, the Court held that ordinary pre-emption principles apply in the case of the petitioners. In its decision, the Court anchored its conclusion on the basis of â€Å"the express pre-emption and saving provisions when taken together, shall create a â€Å"special burden,† which a court must impose â€Å"on a party† who claims conflict pre-emption under those principles. A â€Å"special burden† would also promise practical difficulty by further complicating well-established pre-emption principles that already are difficult to apply† (Cornell). In one of the dissent of the justices, one justice commented that if the â€Å"special burden† would be made applicable in such a case, where the state law penalizes the requirement of the federal law which is an absolute

The music video of Michael Jackson Essay Example for Free

The music video of Michael Jackson Essay The music video of Michael Jackson named Billie Jean maybe considered as one of the best solos written by the great artist. The song was part of the multi platinum selling 1982 album ‘Thriller’. It was produced and written by the artist himself and he believed that the song would be a hit from the beginning. He even quarreled with the producer about including it in the album. He put up a fight with his producer Quincy to keep it in the album. The song was included in the album ‘Thriller’ and became one of the well known ones in the group. The presentation mainly features Jackson being followed by another person who is conceivably a detective of some sort who tries to record some proof about the relationship of MJ with a girl. As usual the whole video is shrouded in an aura of the supernatural and the singer is exalted to another plane beyond that of mortals. This cannot be counted as anything extraordinary, as the technique is employed only to keep the attention of the viewer glued to the screen. The Analysis of Billie Jean The song itself is named after a girl. The girl, according to MJ, is a model of girls called groupies. Groupies, who hung around back stage doors, loved performing artists, and followed them around on their tours. Such girls often suffered setbacks and were prone to drug addiction and mental instability. The song starts with MJ praising the beauty of the girl, but the mood of the singer in the video is rather gloomy. There is a private detective following him, from what follows, maybe he is trying pick up some piece of evidence. The lyrics ooze out the sympathy of the singer to the girl and the video shows him slipping from the person following him. The first feel that you get when you watch the video is the sad mood of the song as well as the lyrics. It goes without mention that the solo is rather in empathy with the girl in the poem. It is seems as if Jackson was sad that he had broken somebody’s heart. But at the same time he is rough with the rough. He traps the person who tries to trap him, maybe a paparazzi of some sort. The video depicts Jackson endowed with the supernatural, as in many of his other videos. It starts in a shady part of the town, being changed by the presence of the singer. The setting suits the mood of the poem and indicates the gutters in which MJ’s imagined lover lives. His steps are marked by light and he exudes kindness in his actions and gestures. He is followed by the detective (or reporter) who tries to be inconspicuous. After this a newspaper that shows ‘Billy Jean Scandal’ written on it is shown falling from the hands of the detective, which puts us directly in the middle of the scandal that Jackson faced a short while before the video was made. The lighting up of the steps, the sudden alteration that happens to the man who is given a penny by Jackson, his disappearing act twice in the video, all give it an appearance of the majestic presence and prowess of the singer. It is a device used by the icon in many of his songs and this cannot be seen as something calculated to make him a mythical icon or something equivalent. MJ was the first among many who successfully utilized short videos to convey a strong background to the song and dance, thus keeping the audience spellbound. The video is made to suit the lyrics and it is the lyrics that clearly get the upper hand during the song. Without such powerful lyrics the song may not have become such a hit. The best reason for this assumption is that the lyrics could stand alone, but the video could not stand alone and a viewer would not be able to make heads or tails out of it. â€Å"But the kid is not my son†¦Ã¢â‚¬ is a very powerful phrase oft quoted within the lines in the poem. Then the newspaper headline ‘Billie Jean Scandal’ clarifies only with the â€Å"She says I am the one†¦.. †. At first it is a sign of negation, but later on the tone changes, that though he sounds to be sympathetic, he is also saying that he has done nothing wrong. It is as if the singer was laying out his innocence as well as his competence to deal with the traps before the audience. I feel that we should consider the fact that MJ was also a partner in the production apart from Quincy who produced the video. Jackson’s experience with the groupie an year back could have controlled the way he produced the video. If this was an outburst, he would have certainly left some clues within the video, even while negating it before the public. The clues would be there, for those who knew where to look for them. We find that the experience was personal and reflected in the video, under close scrutiny. The girl on bed whom Jackson is photographed with, by the detective is anonymous. We should read this together with â€Å"the kid is not my son†¦Ã¢â‚¬ . He never negates what the girl was to him. His approach to the girl is sad and thoughtful and not menacing. The video is also sympathetic with the girl, because he approaches her in the bed. ( It could also be that it was done to trap the detective, so that the he could be trapped by the police). MJ uses several techniques in the video to make it convey the mythical image of the hero. The steps he take is always lighting up. Even the pillar he leans on lights up. Once when the detective tries to catch him he just disappears. The lighting up technique is later used to show the invisible presence of MJ following the arrested detective. Another technique is the presence of the cat, which can be seen to change its size. All these things work together to capture the attention of the viewer. We should say that he succeeded in this technique. Another major success that was achieved by MJ was that he left many things unsaid and left it to the intelligent viewer to decide about it. It is true in the case of short films that often the director feels it painful to leave out scenes that were difficult to shoot. But MJ has been careful to present only the bare minimum that was needed to present the story, and left the rest to the viewer’s imagination. Another great technique is the start/stop dancing technique of MJ which gained popularity with his as well as his teams support. This is what makes the video exceptional. The technique is physically very complicated and gained popularity around the world with its use by MJ. The dance stills used in the video is superb and the all compliments are due to the editor who has done wonderful job of editing the whole video to perfection. This comparatively slow number catches all the attention of the audience. Its title was actually related to another video in the same album, ‘Wanna Be Startin’ Something’, rather than any connection with the star tennis player, Billie Jean King. First of all, the solo was introduced into the album which was named ‘Thriller’. As we hear the song, we find that the other songs are fast whereas this solo could not have withstood the heavy onslaught by other numbers. But, it was Jackson’s creative genius and a deep understanding of his audience that made him confident that audience could accept this slow number. He has said earlier that he knew the song would be a hit, because he felt exhilarated after writing the lyrics. His capability to keep his audience guessing along with his inimitable dancing style has made the video wonderful. I feel that the video was created with the effort enhancing the dream lover image of Michael Jackson. With the mighty stroke of an artist he establishes himself as the lover of dreams and the same time capable of outwitting his numerous enemies. He silently accepts the love of the girl, whom he agrees to be a groupie and proves to be too slippery to fall into a trap. He has appeared in another of his albums as lover cum vampire and I would even dare to say that he was a forerunner of Stephanie Meyer, who wrote the book ‘Twilight†. He has successfully established for himself, an image of the superhuman lover, that every teenager longs for in his/her unconscious. In this video, he has further enhanced it. This should be read side by side with the lyrics â€Å"People always told me be careful of what you do And dont go around breaking young girls hearts And mother always told me be careful of who you love And be careful of what you do cause the lie becomes the truth† Thus he indirectly speaks about his enticing personality and at the same time expiates himself of any connection with the girl in question. But then, he keeps himself open to relations. The versatile genius of MJ is very clearly brought to light and he is able to project himself as the youth icon, around the world. This video is a very good example for that. He also keeps everyone guessing and glued to the screen till the end of the video. Conclusion Michael Jackson was the undisputed king of pop music. The video was a landmark in the life of MJ. His ability to touch the hearts of his viewers was once again brought to light. The video earned him many awards and made him top many charts in America as well as Europe (Michael Jackson – Billie Jean (4:51)). Works cited: Michael Jackson – Billie Jean (4:51). Teaching Philosophy :: Teachers Education School Essays

Teaching Philosophy Education is the foundation of each person's knowledge, skill, talent, and understanding. Each and every person in the world has benefited in some way from the act of another person teaching him or her something, whether it is inside or outside of the classroom. Truly, people learn a great deal from experiences outside of the classroom, but a school provides the means and foundation for education, and everybody takes away more than facts and answers from it. A school gives someone the opportunity to think, challenge him or herself, solve problems, and search for answers. It is where people discover how to learn on their own and, in doing so, they can take this with them into the "real world," since learning is a never-ending process. Teaching for me isn't an act of lecturing and dispensing facts, answers, and an endless amount of information. Rather, it is an interactive process where I can give my students the greatest opportunity to think on their own and begin to learn how to discover answers on their own. As a teacher, I am concerned with providing the tools for learning, rather than the facts and answers to problems. My students need to be actively engaged in their own learning process and in the discovery of answers. Learning is a continual process through life. My goal is to provide my students with the appropriate tools so they can take them into the world and continue to use them after leaving my classroom. They should never be without the tools to discover, solve, and experiment in their own lives. If they should ever, at some point in life, stop in their pursuit to discover a new idea, then I have not one my job successfully. It is my job as the teacher to get my students to find the answers to questio ns they do not know. Just as I say I never want my students to stop learning, the same applies for myself. Teaching isn't just a profession for me; rather it is a foundation for learning. Teaching allows me to continue learning new concepts and ideas. There are so many new discoveries found everyday, and teaching allows me to share these new ideas with my students in the classroom to not only enlighten them, but to enlighten myself as well. Teaching allows me to grow with my students and is never a static job.

Nurse Leader Essay

Nursing leaders are crucial to any nursing organization. They motivate, empower, influence, and communicate the organization’s vision to create change within the organization. Respectable nursing depends on noble nursing leaders. This paper will highlight Florence Nightingale nursing leadership and describe her leadership characteristics. It will further depict the democratic style Florence Nightingale utilized throughout her career. Florence Nightingale was not only a nurse, she was a researcher, educator, and theorist. Her contributions to nursing and society are numerous. Florence Nightingale has been referred to as the â€Å"mother of modern nursing† (Johnson & Webber, 2005). Through her work and example, nursing became a respectable profession for women. She collected data through observation and research and applied that knowledge to social reform on the issues of public and military health and sanitation at home and abroad, rural hygiene, hospital planning, organization, and administration, rights of women and the poor, the definition of nursing, and the need for trained nurses and midwives to care for people in workhouses, hospitals, schools, penitentiaries, the military, and at home (Wellman, 1999). Due to the nature of her work and her commitment to improved patient outcomes by developing best practices based on observation and research, she should be considered the first public health nurse and champion of Evidence Based Practice. She is responsible for initiating the professional education of woman in nursing outside of the sisterhood and promoting their employment in hospitals and workhouses throughout England and abroad Florence Nightingale was a theorist. She developed her Environmental Model in 1859 and titled it Notes on Nursing: What It Is and What It Is Not based on her observations and experiences while treating the soldiers during the war (Johnson & Webber, 2005). Nightingale wrote: In watching disease, both in private houses and in public hospitals, the thing which strikes the experienced observer most forcibly is this, that the symptoms or the sufferings generally considered to be inevitable and incident to the disease are very often not symptoms of the disease at all, but of something quite different- of the want of fresh air, or of light, or of warmth, or of quiet, or of cleanliness, or of punctuality and care in the administration of diet, of each or of all of these (Nightingale, 1860, p. 2). Florence wrote these notes on practice, not intending them to be a manual on nursing, but ideas or women who take care of others because she felt that at some point, nearly every woman nursed somebody in her charge and it was up to them to manipulate the environment to help nature take its course (Nightingale, 1860). Her model includes 13 constructs with recommendations on implementing them. They are: ventilation and warming, health of houses, petty management, noise, variety, taking food, what food, bed and bedding, light, cleanliness of rooms and walls, personal cleanliness, chattering hopes and advises, and observation of the sick (Nightingale, 1860). Although Nightingale did not intend for her writings to become a teaching manual for nurses, her ideas were clearly applicable to teaching nurses how to care for the patient environment and was eventually used in her school to do just that (Johnson & Weber, 2005). Some of her hints on nursing are still applicable to practice today. They represent a holistic view of nursing by addressing the physical, mental, and social aspects of the patient environment. For instance, cleanliness of air, water, home, linen, and person are still important and helpful in preventing disease and promoting health. Also, adequate nutrition and sunlight are necessary for proper bodily function. Excessive noise and lack of variety can be harmful to mental health and must be remedied. Lastly, as nurses we still observe the sick, keep track of their vital signs, likes and dislikes, and monitor changes in their condition. All of this we record in the patient’s chart much like Nightingale did when she recorded her observations 150 years ago. Although Nightingale’s Environmental Model does not meet the guidelines of modern theory and has not spawned the same quantity of research as contemporary models, it can be said that her ideas have influenced nursing theorists and their respective models. Like all nurse theorists, Nightingale used her personal, spiritual, and educational experiences to guide her ideas (Johnson & Weber, 2005). The Living Tree of Nursing Theories was developed by nurses to illustrate the influence of Florence Nightingale on later nurse theorists. It proposes that person, environment, health, and nursing are the roots of the tree and Nightingale is the trunk supporting the branches, which are the modern theorists (Tourville & Ingalls, 2003). In essence, without Florence Nightingale’s work and ideas, nursing theory would not be the same as it is today. She created the fundamentals on which nursing theory is built. In fact, when comparing modern theories to the Nightingale Model many similarities can be appreciated. Henderson was concerned that the early nurse practice acts did not clearly cover what nursing is and therefore promoted an unsafe environment for the public. She helped define what nursing is and what it was not. Her definition reads: The unique function of the nurse is to assist the individual, sick or well, in the performance of those activities contributing to health, or its recovery (or to a peaceful death) that he would perform unaided if he had the necessary strength, will, or knowledge. And to do this in such a way as to help him gain independence as rapidly as possible (Johnson & Webber, 2005, p. 133). A direct connection can be made to Nightingale’s model if one considers the changes in societal expectations and the growth of the nursing role from doer to helper in the 100 years between when the two theories were written. Henderson promotes helping the patient achieve independence through nursing assistance that Nightingale did not. Her 14 components of nursing are similar to Nightingale’s 13. They include: breathe normally, eat and drink adequately, eliminate body wastes, move and maintain desirable postures, sleep and rest, select suitable clothing, maintain normal body temperature, keep the body clean and well groomed to protect the integument, avoid dangers in the environment and avoid injuring others, communicate with others, worship according to one’s faith, work in such a way that there is a sense of accomplishment, play or participate in various forms of recreation, and learn, discover, or satisfy the curiosity that leads to normal development and health using available health facilities (Johnson & Webber, 2005). Faye Abdellah’s theory titled, Patient-Centered Approaches, is just that, patient centered. Her 21 nursing problems are also similar to Nightingales 13 ideas and when advances in science and understanding of how the human body functions are taken into consideration a direct correlation can be established. Lastly, Sister Callista Roy’s Adaptation Model relies on the construct that the role of the nurse is to manipulate the environment to free patients so that they can adapt to other stimuli. Although this is a deviation from Nightingale’s theory, both nurses believed in the reparative process of providing the optimal environment for healing (Johnson & Webber, 2005). In conclusion, Florence Nightingale was instrumental in influencing nursing and society by opening the door for women to practice as nurses, promoting nurse education, guiding evidence based practice through her research and observations, by being a human rights advocate, and by working tirelessly to improve the health and quality of life for people throughout many nations. Florence Nightingale devoted her life in the pursuit of helping others.

Engineering Project Management Essay

.) Why do most people get the order of development that is from objectives/constrains to scope, back the front? Does it means that they don’t know what they are doing, but rather they are going to through motions in a mechanical/ unit thinking fashion? Or are the people unaware of the components of systematic problem solving and how fit together? Answer: Most people do prepare to get the order of development that is from objectives/ constrain to scope, /back front because people wants it to have the answer of their needs and wants as directly to the point or succinctly enough to the correct answer. People seem to be very economical and time conscious as well. Also right order hinders to focus on objectives why one should make interest to the order. To people whom did order that is from objective know a lot if the program or has already that vast knowledge of the program. Related studies of the brand and Brand Communications: Understanding the relationship between consumers and brand is crucial to differentiation in word products as well as to communicate effectively with them. This course is devoted to its analysis to what the brand mean to the consumers through different career and lecture, including models that give clues on issues as investment needs and communication disciplines better suited to reach effective marketing targets. Hence, showing above examples give the idea that customer has a very good background and knowledge of the program order. Thus mostly they should have to see to it that the orders they will aim to suit their knowledge or facts they learn beforehand to ensure better development they sought to aim. The users awareness are very much acquainted with their responsibilities that’s why they are looking on orders that is sought to direct needs they wanted to have. Likewise, people all knows much the suitable problems that are suited to the systematic answer to the problem. There is no doubt have the ignorance of people to those people ordered such program. Mostly they do have already the knowledge to reach out the needs of the problem for themselves. Q2.) Consider a project with which you have been involved and consider the time horizons of the program involve. How many programs were necessary and what time horizon was used in each program? Answer: Upper level program simplified example a project involving a conference. (Work parcel names have been abbreviated because of spaces limitations – work items are simplified.) For this program example, needs to consider the time horizon involve. Considering the presentation the representation of the program having overall program, which is the major work, showed also major parcels, milestone and key resources. Then the next presentation is for a medium range program showing details over the next shorter program that follows then the daily program. By looking at the presentation there was four programs involve and can be taken into consideration each of which has different time horizon depending on the task or degree of emphasis the program to consider. There is that time constrain from the highest level down to next level. The time allotment differs like from highest rank that needs a biggest time allotted, followed by the next higher time consumption then next followed by the lowest time allotment. In the lower level, the time is given daily task compared to other program as well. Now it must to see to it that at different levels of program it has also different time horizon so that we have to make good at the start since there was that saying, the first impression last. Meaning, that the starting work program should be done perfectly so that it may issue along with the preliminary project program, a tendency will occur that entire project will develop into a detailed execution and a well-planned program. Q3.) Why do you believed there have been no negligence action brought against project managers? Do all project managers act in a reasonable industry accepted fashion? Do all project finish on schedule under cost and to better than expected quality? Answer: Project managers belong to the senior management program in a higher level. Owner per see took all the risk provided by the company. So no one dares to questions negligence action brought against the manager since he or she was the brain of the system. All the decision and moves of the manager should all followed by the subordinates. Well for humanitarian reason there were a case also that subordinates can react bad action or decision made by the manager. So probably the subordinate go against the manager and questions his personal actions maybe. So tendency the subordinates will questions the credibility of the manager. Well, we can take into accounts that manger is a human being so he has or she has that weaknesses too. But a fact that the managers are the one manages the company; the subordinates in humanitarian reason can right away react to what her or his fashion to go against the manager. Not all project finish on scheduled time of deadline were all under cost and to better than that of expected quality. If in case such situation to occur then that is one of its kind to cherish and to prioritized if ever the next project will come, it will be the best model or should to follow in the future activity. But usually if the project finishes under cost, it is expected that the results sometime below or maybe just meet the quality that is expected to come. No wonder that cost and expenses will goes hand in hand in quality products. Now a days seldom or none at all you could find under cost that has good quality. The reason is the fact that economy underwent in all aspect of society. Q4.) Why are people found it hard to define the scope and detail of the work involved in project management? Answer: People find it hard to define the scope and details of the work involve in project management since in every company has its own principle of management. In each company there is varied principle that is injected in the management of the company. The reasons of these are depending on the needs and interest of the company scope of preparation. So for us people who are just followers or subordinates just depend on the outcomes but not the makers of such. Not all people knows or knowledgeable enough to the process and what’s was going on the company itself. There is that so called hidden documents that are not supposed to be displayed on public for security purpose and reason. The same a person even how one so introvert to showed what was her or his personality will be to the public but still she or he has that attitude that only him or her knows better. Such characteristics are also present in every company to be a successful one. It should be the case to be done to hide some documents coz might be other program or company will imitate the success of one company so the identity might be duplicated and that identity of the company can be protected as well. Q5.) Tender documents usually comprise the following,   . All notice(s) to tender . All condition of tendering (including form of tender) . The general conditions of contract (to be) . The special contract (to be) . The specification . The drawings . The schedule of rates (prices)/bill of quantities of rates (if any) * List other special arrangement of which you are aware that sometimes hold during the tender period? Answer: The period of adjustment is very crucial period. This is called the tender period in which starting transaction will be done tenderly. But if with stress and plenty of commands will make it very confusing on the part of the doer. So at tender period all notices should be imparted one at a time. No overlapping and should be short and concise so confusion will be avoided. Conclusions and generalization are made to be clear and worth discussing, so the doer can easily grasp and understand the matter. Other special arrangement to considered at tender period is to put into details the rules and policies that imposed in the process so it will goes smoothly along with the rest of accompanying rules and regulation posted. Primarily these rules and regulations must be clear and understood well by every member in the company. Q6.) Is it possible to have one section of the tender documents purely related to administrative matters, and one section purely related to contractual matters/or they necessarily linked. Explain your view. Answer: In my own view, there must be a separate confidential section of tender documents that is for purely related to administrative matter and separate to contractual matter. Not necessarily that the two tender contacts link together but both must only parallel to each other. The reason why they should be separated because per records must have their own identity for the purpose but has its only one aims for the success of the project. Matters that is confidential, not proper to discuss openly to the public for discussion or what so ever. That confidential matter is only good for inner transaction that only the one concerned knows the secrecy of the documents but it should all documents parallel for the purpose of improvements and success of the program as well. In other words, it is by virtue of the fact that mangers are organizationally compelled to make a difference to the resources they combined via performing the function of planning, organizing, leading, controlling, etc., that certainly characteristics of the managing task. Lets take into consideration an example of principles. â€Å" Neo-Marxist perspective on management has emphasized the centrality of management contract in securing transformation of labor power to actual labor in context of capitalist relation of production† ( Ackroyd, Stephen. Bibliography - Microsoft Office for Windows 95 Using Office Binders to Combine Documents [Supplemental Information] - [Why use Binders?] If you have a project that involves several different types of documents, for example, a cover letter written in Word, a financial statement prepared with Microsoft Excel, and a presentation in PowerPoint, it might be easier and more efficient to store the documents together in a Binder. Binders provide a very easy way to work on a document using the full capabilities of the application without removing the document from the Binder. The advantages to using Binders include: + Each document stored in a Binder becomes a section in the Binder. You can open and save the Binder and the sections it contains as a single document, and you can print the Binder as a whole. You can apply styles and use spell checking in all the sections, set specific properties for the whole Binder such as page orientation, and route the entire Binder through electronic mail to coworkers. + You can organize Binder sections in whatever order you like, and you can apply continuous page numbering and headers and footers that run throughout. + A number of ready-to-use Binder templates are supplied with Microsoft Office. Use Binder templates to quickly create a consistent look for all the sections of a Binder. To locate the Binder templates, click New Binder (File menu) and then click the Binders tab. + If you create a Binder format that you want to use as the basis for more than one project, you can save it as a template. + You can easily reorganize sections in a Binder, and you can quickly add and remove Binder sections. [When to work with sections outside a Binder] Because Binders are designed to help you organize and manage related documents, some application features are unavailable while working within the Binder. For example, the Binder has a Status Bar to display information about the sections of the Binder, so the individual application Status Bars are turned off to avoid confusion. For example, since the Microsoft Excel AutoCalculate feature is on the Microsoft Excel Status Bar, it is unavailable inside the Binder. The following features must be used outside the Binder. To work outside the Binder, click View Outside (Section menu). To return the document to the Binder, drag it into the left pane of the Binder window. If the Binder window is not divided into left and right panes, click the button to the left of the File menu. + If you want to view a Binder section in Print Preview, open the section outside the Binder. + The PowerPoint status bar does not display when a PowerPoint document is a section in a Binder. If you want to display the PowerPoint status bar, open the PowerPoint section outside the Binder. + If you want to use the Microsoft Excel AlwaysCalc feature, shared lists, or templates, work with the section outside the Binder. + When working in a Microsoft Excel section, the changes you make to the screen view (View tab, Options command, Tools menu) will not be saved when you save the Binder. + You can run macros in Binder however, you must edit macros outside the Binder. To do this, click the section that contains the macro, click View

Julius Caesar- Shakespeare Essay Essays

Julius Caesar- Shakespeare Essay Essays Julius Caesar- Shakespeare Essay Paper Julius Caesar- Shakespeare Essay Paper Essay Topic: Julius Caesar Julius Caesar, a Roman tragedy was written by William Shakespeare in 1599. It was one of the earliest of Shakespeares three Roman history plays. The play is based in real events the assassination of Julius Caesar, the Roman dictator on 15th March 44BC. Although Julius Caesar is set in Rome over 2000 years ago it explore themes that have a contemporary relevance to the Elizabethans. Julius Caesar is murdered and has left no heir or successor. Queen Elizabeth of the Shakespeare time also did not leave an heir to the throne, which caused a lot of confusion for the Elizabethans. The Elizabethans appreciated the play as it was covering the same situation they were in. Four hundred years before the play was written, the last king of Rome had been removed as he had proved to be like those before him. The Monarchy was replaced by the republic and the Senate took charge. This shows how easy it is to get dispose of rulers who become to powerful and tyrannical. Brutus and Mark Antony are the primary sources of the plays plot. The play is tightly constructed. It establishes the dramatic problem of alarm of Julius Caesars ambition to become king or dictator. In the very first scene Caesar has become so powerful and liked by the Senate and the people of Rome that it is likely he will be declared king. The Republicans however do not like this idea of him becoming king, as their republic, a system of government with a careful balance of power may be at threat; so a group of conspirators (Cassius, Casca, Trebonia, Caisus Ligarius, Decius Brutus, Metlus Cimber, Cinna and Caesars great friend Brutus). The two characters Brutus and Mark Antony (who was not part of the conspiracy) both speak at Caesars funeral. Each had his own reason and purpose for doing so. Both speeches had their own addressing the crowd as well as differing styles. Therefore, differing effects on the crowd as a result of their differing styles and techniques. Brutus was first to speak. If the play was staged he and the conspirators would approach the stand with their hands dripping in Caesars blood, creating a victorious effect. Brutus approaches the crowd by stating his reasons for killing Caesar. He explains to the crowd that Caesar was removed due to his ambition and that if he were to become king, Rome would be destroyed. Brutus speaks in prose (lower class language) so that he is able to speak and communicate with the crowd properly. He begins his speech with Romans, countrymen, and lovers; this shows he loved Rome more and addressed them a Romans first because it was more important to him, it shows he is patriotic. His reason for killing Caesar was not because he did not love him, but because he lived Rome more. He says: Brutus rose against Caesar, that is my answer: Not that I loved Caesar less, but that I loved Rome more (Act 3 scene 2 lines 21-22) This quote basically proves and summarises Brutus point to his speech. His speech was very formal, and it seems that all of his sentences were balanced. Although Brutus did a very good job in explaining to the crowd that murdering Caesar was for the good of Rome, he still hadnt won them over. Brutus explained that he loved Caesar and cared for him but his death was for the good of Rome. As Caesar loved me, I weep for him Brutus explains here that he still cared for him and he also claimed that Caesar was not good for Rome because he was ambitious. Brutus came into a confused and curios crowd. After he explained himself and his purpose, the people were reluctant to believe him, however they were convinced for only a short time. Mark Antony makes a speech after Brutus. He has a difficult task of speaking to a hostile crowd outside the Roman Parliament where Caesar was stabbed to death. Anatonys speeches are very different from Brutus and are far more subtle than Brutus. They were full of clever techniques to manipulate the audience. Brutus spoke to the crowds about honour, patriotism and history. Antonys speeches were more emotional and by being emotional it manages to be more powerful and have a greater impact on the crowd. Julius Caesar and Antony were very close friends; and were always seen together. At the Feast of Luperculia Caesar and told Antony to touch Calpurnia during the race and Antony replied I shall remember: when Caesar says, do this, it is performd. This shows that Antony has great love for Caesar and Caesar also trusts Antony. Antony is much angered at Caesars death but skilfully hides his true feelings from the conspirators. When he was with Brutus and the conspirators he said he is does not doubt them and believes their reason for killing Caesar and he also shakes hands with each one of the conspirators. Antony vows to make the conspirators pay for the death of Caesar and plans to cause havoc and chaos and will not stop until the conspirators are killed and Caesar death is fully avenged. Domestic fury and fierce civil strife shall cumber all the parts of Italy (Act 3 scene 2, lines 263-264) Caesars death is then followed by a time of confusion and bloodshed as the Republicans and Antonys supporters struggle for power. There are many questions that can be asked: what is best for ordinary people? Who will be the next heir, as Caesar has not left one? The audience of Shakespeares time would be asking themselves these same questions as Queen Elizabeth I was coming to the end of her reign. There was an argument about who the successor would be, as she had no children. It was the same with Julius Caesar. Who would be the heir Mark Antony or Brutus? Antony uses his opportunity to make as speech at Caesars funeral to manipulate the crowds way of thinking. He enters the scene with Caesars body, creating a dramatic effect. He starts his speech with friends, Roman, countrymen because he wants to come to them as a friend rather than a ruler trying to gain power and by doing this he puts them at ease. He speaks in blank verse and tries to flatter the crowd. He then continues by saying that he has come to bury Caesar and not to praise him so he can ease in praises of Caesar without the crowd stopping him. It also grabs the attention of the crowd who thought he would praise Caesar and not speak ill of Brutus. He starts off by saying negative things about Caesar but slowly and skilfully begins to talk about his positive side more. The noble Brutus hath told you Caesar was ambitious . For Brutus is an honourable man. Antony sound very sincere when he says this. He repeats this statement three more times which becomes increasingly sarcastic, he finishes with, yet Brutus says he was ambitious, and sure he was an honourable man. Since people were persuaded by Brutus speech, Antony could not insult Brutus honesty. Antony says, I speak not to disprove what Brutus spoke, but that is exactly what he does. Antony uses emotional words and many dramatic devises to win over the crowds. He pretends that he is no good at public speaking. This creates sympathy for him, as the crowd will think it was hard for him to speak to them. For I have neither wit, nor words, nor worth. Action, nor utterance, nor the power of speech (Act 3 scene 2, line 118-119) As a condition for doing the speech, he is not allowed to blame the conspirators; Antony gets round this by subtly changing meanings of words such as honourable. Honourable is a very strong word and it is Brutus best quality. Antony degrades this word by making a point that Caesar was not ambitious and then adds that Brutus was a honourable man. This effect creates doubt in the audiences mind. He uses techniques like sarcasm. Antony talks about Caesar very passionately to give the impression that Caesar is a hero and causes the crowd to think about how they lost such a great man. He hath brought many captives home to Rome, Whose ransoms did the general coffers fill. Did this in Caesar seem ambitious? (Act 3 scene 3, lines86-88) This quote tells us the audience that Caesar brought captives and money, which he gave to the public funds. Caesar wanted nothing but the best for the people of Rome. Antony wants to show that Caesar was not ambitious by providing four reasons as evidence. These are: * He brought many prisoners whose ransoms filled the treasury. This makes the audience realise that what ever Caesar done was for Rome * When the poor cried Caesar wept in sympathy. This shows that Caesar was concerned about the citizens and the welfare of Rome, it also shows that Caesar was emotionally weak, but ambition should be made of sterner stuff. * When Caesar denied the crown three times. I f Caesar wanted to be come king and if he was ambitious, why didnt he take the crown at the feast? The will Caesar left for the people. If Caesar was ambitious and greedy why did he leave the people of Rome 75 Drachmas and his private walks? Antony deals wit Caesars worst point, his desire to become king of Rome by making you believe he denied the crown three times at the feast of Lupercal because he had no desire to become king. The use of Caesars will as a stage prop arouses a lot of attention from the crowd. He tells the crowd about it but then deliberately changes to another point. By using this delaying tactic he keeps the crowds attention. He continuously prolongs them and builds up a climax. He also asks the crowds permission to read the will You compel me then to read the will? - This technique makes the crowds think that he is a helpless man and he has no power over anything. It makes the crowds believe they are telling him what to do. After mentioning the will he tells the crowd to gather round Caesars body. He uses Caesars body as a tool of manipulation. This creates a very dramatic effect as the crowd see what the mighty Caesar has been reduced to. Antony continuously uses repetition and questions Brutus honour. He uses many dramatic devices, which Brutus doesnt use. By the end of his speeches the crowd are against Brutus. This shows that the crowds are not strong in their convictions and Antony is able to fickle the crowds easily. Antony uses a dramatic effect on the people, first by entering the stage with the body if Caesar and then at the end stating his heart is still with the body of Caesar, ending his speech weeping. The effect of Antony showing the crowds Caesars cloak, full of knife gnashes, is very dramatic and emotional. He talks of blood to move the citizens to pity and anger. He describes the killing as brutal and unforgivable. He is able to get the people to question the killing of Caesar. The crowd begin to doubt Brutus. If you have tears, prepare to shed them now (Act 3 scene 2, line 167) Antony tells them they will be overcome with emotion. By mentioning the bloody cloak he makes it more visual and brutal. He mentions the cloak deliberately and tells us about the first time he wore the cloak, when he defeated the Nervii, as Caesar was known for his skill at war. He reminded them what Caesar had done for them. Antony opens the appeal for sympathy by using emotive words and exaggeration, which make you feel sorry for him. He tells the crowd about the first time Caesar wore the garment in which he defeated the Nervii, but then dramatically starts telling the audience about the rips in the torn and bloody piece of cloth. That day he overcame the Nervii. Look in this place ran Cassius dagger through (Act 3 scene 2, lines 171-172) Antony continuously uses emotive language and devices to steer the crowds. While speaking he stops and says: Bear with me. My heart is still in the coffin there with Caesar (Act 3 scene 2, lines 103-104) This shows how distraught he is that he has to stop before continuing. This gives time for the crowd to stop and observe his behaviour. The crowd begin to question themselves and are deeply affected by his emotion; and when people are emotional they cannot think rational. Antony pretends to know who made which wound and pretends to recall each little detail, which causes the audience to become angry and pitiful. He makes it up in order to make it seem more barbaric. Look, in this place ran Cassius dagger through: See what a rent the envious Casca made (Act 3 scene 2, lines 172-174) Antony gives a very detailed account of when Brutus stabbed Caesar. The image of blood stir the crowds up and it makes you think about inhumane way Caesar was killed. He gives a detailed account of when Caesar stabbed him so the crowds realise what a traitor he was and how he rose against his friend because of jealousy. Mark how the blood of Caesar followd it, As running out of doors, to e resolvd If Brutus so unkindly knockd or no (Act 3 scene 2, line 176-178) At this point the crowd is so emotional that Antony no linger needs to use the word honourable after criticizing Brutus. Antony also says in his speech: For Brutus, as you know, was Caesars angel. He says this to show that Caesar loved him greatly and trusted him. He was betrayed by his best friend, Brutus; He was a traitor. Traitor is a very strong word. The Elizabethans believed that if someone was put in power, God put them there and no one could remove them. If you tried to remove them you were classified as a traitor, which was the worst thing for them. All of these tricks used by Antony were successful and were able to steer the crowds to think that Brutus and the conspirators were nothing but brutal murderers and they killed Caesar due to jealousy. After showing the crowd Caesars cloak, Antony removes it showing the disfigured corpse of Caesar. The crowds horror and anger reaches its highest climax and the crowd want revenge Antony again pretends to know who made which stab in Caesars body. He talks about blood, which again causes the crowd to become emotional and pitiful. O woeful day! O traitors! Villains (Lines 198-199) This quote shows that Antony was successful in his aims. He has the crowd so wound up and fumed with anger they will do what Antony could not do. Antony uses words such as Good friend, sweet friends to make the crowd feel at ease and make them trusted. He tells them he is a friend and means no harm. Antony is easily able to fickle the crowd as they are not strong in there convictions. Antony is able to prove to the audience that the conspirators are not honourable, but were heartless butchers. They who have done this deed are honourable. (Line 209) He also exaggerates and lies in his speeches. He says I have neither wit, nor words, or worth. These are used to create sympathy for himself. Antony has these qualities and proves it by using them. But were I Brutus And Brutus Antony, there were an Antony Would ruffle up your spirits. (Lines 223-225) Here Antony tries to say that Brutus would cause a riot and tell them lies, but he has done this himself. This also shows how hypocritical Antony is and the amount of lies he tells to sway the crowds to believe him. The use of rhetorical devises and persuasive language in Antonys speeches create great emphasis on the innocence of Caesar. The repetition of the word ambitious keeps the reader wondering if Antony is correct, that Caesar was murdered for no reason except treason. Brutus speech involved taking a defensive approach, leaving people to their own conclusions. However, Antony takes a prosecuting approach against Brutus, so sneaky that you dont even notice it. Antonys examples give him an advantage over Brutus because he backs up his statements with examples while Brutus leaves his statements open-ended. The people find it easier to accept Antony, an emotional and sincere speaker, than Brutus who appears to be arrogant and forceful. Antony talks about Brutus first and slowly talks about how bad he is while he is doing this he starts talking about the noble Caesar. He uses many positive adjectives such as Mighty Caesar, Great Caesar, and Noble Caesar. He fits them into sentences unnoticeably. Antony has got what he wanted; he has succeeded in his plan to manipulate the crowd. Now let it work. Mischief, thou art afoot, Take thou what course thou wilt! How now fellow (Lines 258-259) Antony does not care of the plebs. All he cares about is his success and his ability to avenge Caesars death. The crowds will burn down houses and kill people but he is not worried about that. Antony proves he has been successful when the crowds disperse to look for the conspirators; they come across a poet called Cinna. They kill him just because he bears the name Cinna even though he has no contact with any of the conspirators. These shows how powerfully manipulating his speeches were. The crowds become brutal and blinded by this manipulation. Revenge! About! Seek! Burn! Fire! Kill! Slay! Let not a traitor live. (Lines 202-203) Antony was successful in his aims to manipulate the crowds after the murder of Caesar. He had a hard task of making a speech to an unruly crowd who had been turned against Caesar by Brutus. He easily changed their way of thinking and succeeded in his plan. I have found that Brutus was honourable but was blinded by his love for Rome and was also easily persuaded by Cassius and the conspirators. He did not think of the consequences and though that the people of Rome would see through his eyes and believe that this was his true reason for killing Caesar. However, Antony was very manipulative and persuasive in changing thee views of the crowd easily. His repetition, positive adjectives, rhetorical questions, sarcasm and pauses all combined to have a very great impact on his speeches, which influenced the crowds. There is a contemporary relevance of Antonys speeches to how modern politicians influence people to vote for them. Modern politicians promise to do the best for the people i. e. improve healthcare, schooling etc and also promise to right the mistakes of the past leaders. They use persuasive language and say the benefits the people will receive if they will cast their vote towards them. Antony used this technique and told the people of Rome what they had inherited from Caesar, but did they receive anything what Antony told them?

The Important of Simulations - Assignment Example They only need to be totally within the computer environment to play any game. Another interesting part of simulation is how the whole concept works. It is hard to believe that something good can come out of mimicking. However, this is made to look more serious where one earns that simulation is not about imitation alone (Pidd, 2003). 2-In the case of any decision making type, the makers of the decisions will have to understand, plan, analyse as well as manage the system. These activities are involved in decision making. Typically, the decisions involve real systems comprised of complex methods with highly interdependent components that exhibit vulnerability as well as change over time. With the absence of a model, makers of decisions would make use of various processes for information gathering from a system that is real, process it and finally select an action which creates some change within the system. In general, model based decision making as well as simulation based decision making particularly do offer decision makers a way of investigating the system’s representation, use alternatives to experiment and then predict the proposed changes effects, that are external to the system. The approach does increase the decision space greatly. This means that it allows for the evaluation of many alternatives. The approach is not invasive on the system and allow for the assessment of risk of actions. For a decision maker to directly interact with simulation models effectively, models require to be entrenched in decision support systems, which enable data entering within the model as well as enhance the model’s output presentation (Pidd, 2003). 3-Some highly complex operations that benefit from simulation include transportation of raw material. Trains or truck, which transport finished goods or raw materials are scheduled as well as planned on the simulation basis. The

Walmarts Ethics Essay Example | Topics and Well Written Essays - 250 words

Walmarts Ethics - Essay Example Walmart is indeed a large organization with thousands of stores in the US and other parts of the world as well. It has employed millions of employees and hence increasing its fame. However, in a bid to maintain its leading retail position, Walmart has had to engage in unethical buyer power where those suffering are its employees, the suppliers as well as other businesses which Walmart has taken businesses from in a bid to continue with its reputation for lower prices. The employees’ medical benefits among other benefits are not offered to all employees even though they work excess hours without much compensation which is an indication of Walmart’s injustice and unfairness to their hard working employees. When the business continues to lower its prices and reduce the purchasing power of the suppliers in a bid to make more profit, it goes against the ethical principle of beneficence and makes small businesses close and moves the business from Americans. This is an indicat ion therefore that when Walmart uses its buyer power and reduces prices; it only benefits its stockholders but harms the rest of the people. If Walmart is to be ethical in using its buying power to reduce its prices, the profits from the reduced prices in their numerous stores would lead to the stores engaging in non-maleficence and more beneficence. It would also be fairer to the suppliers by compensating them for their efforts as well as exercising justice in the workplace about employee’s benefits and be truthful about it.

The Politically Incorrect Guide to Islam by Robert Spencer Essay

The Politically Incorrect Guide to Islam by Robert Spencer - Essay Example Robert Spencer shakes things in an equally controversial book The Politically incorrect Guide to Islam. This book obliterates simplistic, politically correct opinions about the Islam religion. It compares, word by word, the teachings between Muhammad and the teachings of Buddhism, Christianity and other religions. He sent her away until the child was born. When the woman came back after several months, he took the child and gave it to a friend as a gift while he ordered the woman to be stoned to death. This book covers a lot of ground with the study of Muhammad, the development of Quran, the spread of Islam religion, and Islam’s early wars hence the culmination of the Crusades. The book is introduced as an examination of some specific tendentious contentions about Islam religion and the Crusades that have been a source of current debates. Spencer provides readers an extensive exploration about Islam that cannot be taught in school or that may not be exposed in the media; in so doing he paints religion in a broadly negative light. The general notion that Islam is a peaceful religion that has been hijacked by small minority of extremists is the beginning of all PC myths surrounding Islam. To back his claims, he quotes several Western Historical figures such as John Quincy, Alexis de Tocqueville and Winston Churchill who have been vocal in criticizing Islam. The book criticizes Islam as both oppressive and militant and gives a historical account of the crusades based on the argument that they were a late response of European civilization to the centuries of occupation and invasion which started in the 8thC in Italy, France, the Iberian Peninsula, Sicily and major parts of Eastern Europe. Spencer argues that the civilization clash between the West and Islam in the 21stC was as a result of a continuation of a 14thC long jihad which commenced at the inception of Islam. The book also offers discussions about the difficulties of treating this topic in a ever dis integrated current political environment. The fact is the book has both the bright and not-so bright sides. On the bright side, Spencer denies many myths penetrated by the PC crowd: that mainly states that Islam and Christianity are for the greater part been equivalent traditions, that crusaders were selfish land-hungry colonizers, that Jihadists were benign sweetie-pies and many other controversies. Honestly, I do agree with his bruising of Ridley Scott’s Kingdom of Heaven film which depicts a sentimentally liberal Islam during crusades periods. On the other side of the Spence’s book, he gives several myths that need correction. These include: Christianity is essentially begin and Islam nasty The crusades were defensive conflicts We should be grateful for crusades These three points as expressed by Spenser are myths and ironical in nature. 1) Myth one: Christianity is essentially begin and Islam nasty The book â€Å"The Politically incorrect Guide to Islam† is full of â€Å"Jesus vs. Muhammad† punctuations, whereby several teachings of Jesus are compared and contrasted with the intolerant and militant teachings of Prophet Muhammad. Taking for instance page 35: Jesus teachings was â€Å"blessed are the persecuted† and it is contrasted with Prophet Muhammad’s authority to kill persecutors claiming that â€Å"persecution is worse than slaughter† (Qur'an 2:191). Again in page 143, Spencer describes Jesus’ teachings and deeds to be merciful to enemies as compared to Muhammad’s command to ruthless to unbelievers but merciful to fellow Muslims. The mention of Islam develops a feeling of fear on the part of many non-Muslims because of what they have been told or heard about the Muslims. In my opinion, it is pointless to list

Outline Maslow's Hierarchy of needs, Essay Example | Topics and Well Written Essays - 1500 words

Outline Maslow's Hierarchy of needs, - Essay Example This essay would further describe the Hierarchy of needs and would tell as to how the theory is relevant when it comes to use in organizations (Institute of Management 1998). Hierarchy of needs is a theory which can be implemented into practice in organizations because of the context in which it was written. It tells the employers about the human nature and how necessary it is to fulfill the requirements of these individuals in order to attain high performance. The hierarchy of needs is divided into five major representations by Maslow. These needs are basically formatted into a pyramid which shows how they are important. In basic terminology this hierarchy of needs is divided into physiological, safety, love and belongingness, esteem, and self actualization (Institute of Management 1998; Viles 2008). Following is the list that provides the overview of Maslow’s Hierarchy of Needs: It can be derived from the above list that the biological needs are the first ones which need to be fulfilled. Biological needs are the basic necessities of life without which a person cannot survive. Breathing, shelter and biological factors such as homeostasis can be counted in these needs. All these factors are necessary for an individual to survive. If this need is fulfilled then the next human need is of safety. Safety is described in different contexts by Maslow as in the general world this safety implies to be something which is related to justice and freedom whereas in a work environment this safety means the safety of job. In a work environment this safety can also mean the incentives provided for the safety of an individual by the employer when the employee is in need of help. In general it is all what a human may need after his basic needs of survival are fulfilled. After the human needs of safety are fulfilled Maslow states that humans usually run for love and belongingn ess. By love and belongingness here he means that humans need affection from their fellow

Sustainable Management Futures Essay Example | Topics and Well Written Essays - 750 words - 2

Sustainable Management Futures - Essay Example The employer should have justifiable evidence that can convince an outside observer of her claims. The employee should also be convicted that this action of making public the wrongdoings will lead to changes being done. The Disclosure Act 1998 requires employees not to engage in whistle blowing activities. Loyalty is having unwavering allegiance to an affiliation or person Integrity on the other hand is being free of any form of dishonest behavior (Johnson, 2003: 279). When whistle blowing the employee who is loyal to the organization should seek the best for that organization and make justifiable accusations that are not aimed at achieving selfish gain but helping the general majority. Whistle blowing for the right reasons is a positive force in the society as it ensures that people maintain accountability and ethics. Lying is not justifiable at any one time. However I don’t believe that business can be completely ethical especially in price determination. This is because pri ces are determined by the market with all organization trying to make the most profits. The code of ethics is crucial for an organization as it leads to cultivation of good behaviors such as accountability honesty and integrity which makes the organization not to operate smoothly. Legal considerations are crucial because it save an organization or individual trouble with the law. For instance nurses are expected to abide to the rule of confidentiality of their patient (Brenkert & Beauchamp, 2010 618). If they have information about a HIV positive patient and discover that he/she plans to have sexual relations with a HIV negative partner they cannot blow the whistle since they can be sued. Scenario Three Increasing women in the top executive positions increase diversity in the board of directors’ composition. This creates an arena for discussion of different perspectives on issues which helps in making good decisions. Lord Davies report has recommendation on how women represen tation in top executive position in UK can reach to 25% by 2015. The institute of leadership report on women reveals that despite about half of the working population consist of women they are underrepresented in the top executive positions. Women hold only 12% of directorship position and only 22% of top management positions. Barrier to female occupation of top position are gender biases and the fact that women who are also homemakers are unable to give total commitment to work such as working long hours. Promotion today is based on performance. The first wave of feminism started in the late 19th century to early 20th century. This was during the industrialization era and the wave had the aim of pushing for opening job opportunity for women. It challenged the culture of domesticity calling for women representation in the political arena. The second wave was in the 1960s-90s. This came after the civil movement had diet down. The main aim of this was the recognition of female reprodu ctive rights and promotion of equal social rights. The third wave which is also called post feminism started in the 1990s to date. This is where female portray their sexuality by wearing high heels pushup bras and make up (Vinnicombe, 2008; 142). They assert that one can be beautiful and at the same time have brains. In the former waves female sexuality was seen as an object of oppression but it is now viewed as a subject of feminine beauty. Intervention in Nigeria Essay Example for Free

Intervention in Nigeria Essay When called to account for its lack of direct involvement and intervention in Nigeria, especially in the wake of the politically and financially motivated killing of Nigerian activist Ken Saro-Wiwa, Shell ran full page ads in major publications such as the New York Times to defend its non-action. The reason was a seemingly altruistic and simple one, that it is not befitting for a commercial company to interfere in the politics and the rightful jurisdiction of governments (p. 66). The company further postulated that â€Å"the world where companies use their economic influence to prop up or bring down governments would be a frightening and bleak one indeed† (p. 66). Shell was masterfully employing its spin-doctor expertise to protect its own less-than-noble motives in this ravaged nation, with Nigeria as the ironic victim of an internecine conspiracy perpetuated by her own greedy warlords. Both the political and social situation in Nigeria is dire. The commonfolk are oppressed and live in squalor, again painfully ironic considering just how rich and blessed the land was in her earlier years in this century. The extensive oil exploration and eventual access to the source of oil not only caused a physical blemish on the face of the earth, it stained everything that came into contact with it. The air was bad, the land dotted with pipes, significant spillage abounded, and everything looked bleak. However, the real damage was in the conscience and consciousness of the people, from the tyranny of the perpetrators of power and the murderers of those who went against them, to the greed and heavy regard for material wealth by the ruling elite and their goons, and also to the Shell executives who can disregard their involvement in hastening the demise of a people and exploitation at once both moral and monetary in nature. There is simply no justification or rationalization that will reduce the severity of the intransigence on the part of Shell in the intricacies of its dealings with Nigeria and her people. Is there reason for Shell not to be involved? On the surface, it would appear that Shell has a valid excuse; that government and corporations should never mix, and that to be involved that way would be a serious compromise and blur the lines between autonomy and decency, both political and corporate. However, this is no longer a position from which Shell can hide behind. For years, she had been oiling the pockets and hands of the political and military elite who, once their desires and lusts are well-lubricated, allowed Shell to be the instrument of choice in the exploitation and cherry picking of their land and people. Shell gladly positioned herself to play the role with aplomb, and was almost certainly, if not outright, furthering her advances and deepening her profits, while rewarding Nigeria’s ruling class with luxuries at the open expense of the latter’s people. Shell has lost her moral license, and therefore cannot use this excuse to defend her studied indifference to the chaos and calamity that befell Nigeria surrounding the arrest and execution of cause-celebre Ken Saro-Wiwa. Shell was hard-pressed to do something, anything, to boost her image and public relations. She therefore employed defensive tactics that at once denounced the charges against her, shed a few tears on the public stage to proclaim her innocence and inability to interfere, and used some money to pay off the likelihood of further protests. That speaks volumes about her intent to hide the reality of the situation, and it appears that in a fuel-obsessed world, she may have the upper hand yet.

Limitations Of Text Based Image Retrieval Psychology Essay

Limitations Of Text Based Image Retrieval Psychology Essay Sometimes a relevant image might be left out owed to the absence of specific keywords. While often there might be no relevant text surrounding the images or videos, but they are relevant. In fact, there might exist images or videos where the surrounding text has nothing to do with them. In these cases, these returned results might be irrelevant and have nothing in common with the required images and videos. The other approach uses the annotation of the images and vides and is often a manual task. The text-based technique first annotates with text, and then uses text-based retrieval techniques to perform image and video retrieval. Annotation of images and videos lets the user to annotate the image with the text (metadata) that is considered relevant. The text can be time, event, location, participants or whatever the user finds relevant. 2.6.1.1. Limitations of Text based Image Retrieval: Nevertheless, there exist two major difficulties, especially when the volume of image collections is large with hundreds of thousands samples. One is the huge amount of human labor required in manual image/video annotation and is very time-consuming. Textual based retrieval cannot append the perceptual significant visual features like color, shape, texture [Bimbo. 1999]. The other difficulty comes from the rich content in the images and the subjectivity of human perception which is more essential. The annotation of the image and videos completely depends on the annotation interpretation [Enser et al 1993] i.e. different people may perceive the same image differently as shown in the figure 3 . The perception subjectivity and annotation impreciseness may cause unrecoverable mismatches in later retrieval processes. And to retrieve the required data the user constructs a query consisting of the keywords that describes the desired image and video. Although the text based retrieval system has gained benefits of traditionally successful information retrieval algorithms and techniques. Figure 3: Multiple interpretation of same images Park like Tree, Sky, Horse, People, Ridding, Sunny Day, Outdoor Critics of text-based approach dispute that for accurate image annotation it must be automated. The automatic annotation is limited due to its deficiency of extracting semantic information from the images and videos. Only automatic annotation of images and videos in integration with pure text-based image retrieval will be inadequate. The available metadata is mostly restricted to the technical information surrounding the image or video, such as time, resolution of the image or video and name of the image or video. The users may find it difficult to use text to perform a query for some portion of the content of an image or video. Text-based retrieval techniques are absolutely limited to search the metadata that is tagged to the image or video. If the text queried is not annotated with the same tag as attached with the image or video, the data is not returned. This means that if a particular piece of the image or video is interesting this must be explicit included in the metadata. If the desired object is not a main part of the image or video, sometimes it may happen that is not described in the metadata and hence cannot be a retrieve as a result from a query describing such portions of the image or video. One of the disadvantages of text-based image retrieval is that a word can have different meanings. This problem is best illustrated with an example, searching for the images or videos of jaguar or Apple. The system cant differentiate either the user is looking for the jaguar car or jaguar animal as shown in the figure 4. The two concepts have the same name but contain an entirely different semantic idea. The retrieval systems dont have reliable ways to separate the concepts. These problems are present even in systems with automatic synonym lists or thesaurus capabilities [Schank et al. 2004]. There exist several text-based image retrieval services today, Google is a large player. Google is the largest player but still faces the same problem. Figure 4: Same name different Semantics Attempts have been made to make the tags attached to the image or videos more flexible by attaching vast number of descriptive words. The thesaurus based annotation or knowledge based annotation has gained much of the researchers attention [Tring et al. 2000]. Recent development in video retrieval has focused on models that combine several modalities for joint indexing and retrieval. Consideration to the demands, researchers concluded that visual features play a crucial role in the effective retrieval of digital data. This initiates to the development of the content based image and video retrieval [Venters et al. 2000]. 2.6.2. Content based Image Retrieval: The need to manage these images and locate target images in response to user queries has become a significant problem. One way to solve this problem would be describing the image by keywords. The keyword based approach has a bottleneck of manually annotating and classifying the images and videos, which is impractical for the overwhelm corpuses. The human perception subjectivity problem may affect the performance of the retrieval system. Current commercial image and video search engines retrieve the data mainly based on their keyword annotations or by other data attach with it, such as the file-name and surrounding text. This relinquishes the actual image and video more or less ignored and has been following limitations. First, the manual annotation of images requires significant effort and thus may not be practical for large image collections. Second, as the complexity of the images increases, capturing image content by text alone becomes increasingly more difficult. In seeking to overcome these limitations, content-based retrieval (CBR) was proposed in the early 1990s [Baeza-Yates et al. 1999]. Content-based means that the technology makes direct use of content of the image and video rather than relying on human annotation of metadata with keywords. Content-based retrieval (CBR) research endeavors to devise a retrieval system that exploits digital content in the retrieval process in a manner that is eventually independent of manual work. CBR is an umbrella term for content-based multimedia retrieval (CBMR), content based visual information retrieval (CBVIR), content-based image retrieval (CBIR), content-based video retrieval (CBVR) and content-based audio retrieval (CBAR). CBR may also be termed as multimedia information retrieval (MIR). Content based retrieval extract the feature of the image or video themselves and use it for retrieval rather than the user generated meat data. CBR uses the primitive features of the image and video like the color, shape, texture, motion etc. [Sharmin et al. 2002]. Content based system index the images and videos automatically by using different techniques for their visual contents. For the computer, a video is merely a group of frames with a temporal feature, where each frame is basically an image. The computer take each image as a combination of pixels characterize by the low-level color, shape and texture. CBR represents these features in the form of vectors called the descriptors of the image or video. CBR extract these primitive features by using automated techniques and then further use it for searching and retrieval. Thus, these low-level visual features extraction from images and videos has initiated to the many research in the CBR [Veltkamp et al 2000]. A typical CBIR system should be able to interpret the content of the images in a query and a collection, compare the similarity between them, and rank the images in the collection according to their degree of relevance to the users query [Tamura at al. 1984]. The figure 5 shows the typical content based retrieval system. Retrieval deals with the problem of finding the relevant data from the collection of images or videos according to the user request. The user request may be in the form of the textual data or in the form of query by example. Its relatively easy to extract the low level features from the images and videos in the query as well as in the collection and then compare it. Figure 5: Typical Architecture of Content Based Retrieval The paramount objective of CBR is efficiency during image and video search and retrieval, thereby reducing the need for human intervention. Computer can retrieve the images and videos by using CBR techniques from the large corpus without the human assumption. These low level extracted features then represent the image or video and these features are used later on for performing the similarity comparison between the other images or videos in the corpus. These extracted features serve like a signature for images and videos. Images and videos are compared by using different similarity comparison techniques. They are compared by calculating the dissimilarity of its characteristic components to other image or video descriptors. CBR approach shows substantial results with the queries like show me the images or videos of the red color, Show me the image with blue color is above the green color etc. The available automated CBR techniques deal such a type of queries elegantly but flunk to cope with the high level semantic queries like Show me the images or videos of the people in the park, people on the beach, car on the road etc. Such type of queries cannot be tackled successfully by the CBR systems. These queries require more sophisticated techniques to extract the actual semantics abstracted inside it. Related work in CBR from the perspective of images can be found from the overview studies of [Rui et al. 1999], [Smeulders et al. 2000], [Vasconcelos et al. 2001], [Eakins 2002], [Kherfi et al. 2004], [Datta et al. 2005] , [Chen et al. 2004], [Dunckley 2003], [Santini. 2001] [ Santini et al.2001], [Lew et al. 2001], and [Bimbo et al. 1999]. CBIR has received considerable research interest in the last decade [Vasconcelos et al. 2001] and has evolved and matured into a distinct research field. The CBIR mainly comprises of two main steps feature extraction and the similarity measurement. These key technical components of the CBIR system will be introduced in the following sections. 2.6.2.1. Feature Extraction: Images are described by visual words just like text is defined by textual words In fact, an image or a video frame is merely a rectangular grid of colored pixels for a computer. And to a computer an image doesnt mean anything, unless it is told how to interpret it. Image and video descriptors are intended for the motive of image or video retrieval. Descriptors seek to apprehend the image or video characteristics in such a way that it is facile for the retrieval system to identify how similar two images or videos are according to the users interest. CBR system index images or videos by using the low-level features of the image and videos itself, such as colour [Pass et al. 1998, Smith et al. 1996a, Swain et al. 1991], texture [Manjunath et al.1996, Sheikholeslami et al. 1994, Smith et al. 1996b], shape [Safar. M et al. 2000, Shahabi et al. 1999, Tao et al. 1999] , and structure features [Pickering et al. 2003, Howarth et al. 2005]. The color, shape and texture are the principal features of the images. The visual contents of images and videos are then symbolized a s a feature vector of floating numbers. For example, the colour, texture and shape features extracted from an image form an N-dimensional feature vector, and can be written as Where is a vector of its own, and is the colour, is texture and n3 is the shape. While for the video there is an additional vector, where is the motion. In the following section, we introduce the visual features to give an impression of how images and video framesncan be converted into a representation that the retrieval system can work with. 2.6.2.1.1. Color: A very common way to see at images is by analyzing the colors they contain. Colour is the most prominent visual feature in CBIR since it is well correlated with human visual perceptions of objects in an image. A digital colour image is represented as an array of pixels, where each pixel contains three or four tuples of colour components represented in a numerical form. The abstract mathematical representation of colours that computers are able to use is known as the colour model. The similarity between the images and the videos is calculated by using the color histogram value. The histogram depicts the specific values of the pixels inside the image or video frame. The current color based retrieval techniques divides the image into regions by using color proportion. The color based technique doesnt depend on the size and orientation of an image. Since 1980s various color based retrieval algorithms have been proposed [Smith et al. 1996 c]. A most basic form of color retrieval involves specifying color values that can be further used for retrieval. Indeed, Googles image and Picasa 3.0, can also provide the facility to the user to search the images that contain homogenous color composition. The most common representation of color information is in the form of color histogram and color moment. Color anglogram [Zhou X.S. et al. 2002], correlogram [Huang J. et al 1997], color co-occurrence matrix (CCM) [Shim S. et al. 2003] are some of the other feature representations for color. Figure 6: Color based image interpretation 2.6.2.1.1.1. Color Spaces: There are many color spaces designed for different systems and standards, but most of them can be converted by a simple transformation. i. RGB (Red-Green-Blue): Digital images are normally represented in RGB color space; it is the most commonly use color space in computers. It is a device dependent color space, which used in CRT monitors. ii. CMY (Cyan-Magenta-Yellow), CMYK (CMY-Black): It is a subtractive color space for printing, it models the effect of color ink on white paper. Black component is use for enhancing the effect of black color. iii. HSB (Hue, Saturation, Brightness) or HSV (Hue, Saturation, Value): It was used to model the properties of human perception. It is an additive color model. However it is inconvenient to calculate color distance due to its discontinuity of hue at 360. iv. YIQ, YCbCr, YUV: Used in television broadcast standards. Y is the luminance component for backward compatibility to monochrome signal and other components are for chrominance. It is also used in some image compression standards (e.g. JPEG) that process luminance and chrominance separately. Figure 7: The additive colour model HSV 2.6.2.1.1.2. Color Models: A color model is an abstract mathematical model describing the way colors can be represented as tuples of numbers, typically as three or four values or color components. When this model is associated with a precise description of how the components are to be interpreted (viewing conditions, etc.), the resulting set of colors is called color space  [1]  . A color model is a formularized system for composing different of colors from a set of primary colors. There are two types of color models, subtractive and additive. An additive color model uses light emitted directly from a source. The additive color model typically uses primary color i.e. red, green and blue light to produce the other colors. Combination of any two of these additive primary colors in equal amounts produces the additive secondary colors or primary subtractive model colors i.e. cyan, magenta, and yellow. Integration of all these three colors RGB in equal intensities constitute white as shown in the Figurea8 a. Figure 8 (a): RGB: Additive Color for light-emitting computer monitors. Each colored light add to the previous colored lights. A subtractive color model illustrates the blending of paints, dyes,   and natural colorants to produce a full series of colors, each generated by subtracting (absorbing) some wavelengths of light and reflecting the others. Colors observed in subtractive models are the due to reflected light. Different wavelength lights constitute different colors. The CMYK model (Cyan-Magenta-Yellow-blacK) model is the subtractive model. The combination of any two of these primary subtractive model color i.e.(Cyan, Magenta, Yellow) results in the primary additive model or secondary subtractive model color i.e. red, blue, green and the convergence of it constitute black color as shown in the figure 8 b. Figure 8 (b): CMYK: Subtractive colors for Printer. Each color added to the first color blocks the reflection of color, thus subtracts color. For some of the concepts the color scheme helps in achieving suitable results like forest, sky, tree, grass, sea etc. The color descriptor will help in retrieving the accurate results. But for the categories like the car, house, street etc. Color descriptors cant play a vital role. The color descriptor will fail in a situation of the same car with different colors as shown in the figure 9. For the retrieval based on the color two most frequently used representative are color histogram and color moment. These representatives are represented in the section below. Figure 9: Same Car with different color composition a. Color Histogram: A histogram provides a summary of the distribution of a set of data. A color histogram provides a comprehensive overview of the image or video frame in terms of color. A colour histogram for a coloured image describes the different intensity value distributions for colours found in the image. The histogram intent to define the number of times each color appears in an image/video frame. Statistically, it utilizes a property that images having similar contents should have a similar color distribution. One simple approach is to count the number of pixels of each color and plot into a histogram. The histogram h of an image I is represented as: H(I)= Where pi is the percentage of i-th color in the color space, N is the number of colors in the color space. To enable scaling invariant property, the histogram sum is normalized to 1. The percentage is proportional to the number of pixels in the image. Figure 10: Shows the Color Histogram Mostly commercial CBR systems like Query-By-Image-Content uses color histogram as one of the feature for the retrieval. Colors are normally grouped in bins, so that every occurrence of a color contributes to the overall score of the bin it belongs to. The bin explains the intensities of different primary color i.e. quantity of red, blue or green for a particular pixel. It doesnt define individual color of the pixels. Histograms are usually normalized, so that images of different sizes can be fairly compared. The colour histogram is the most commonly and effectively used colour feature in CBIR [Swain et al. 1991, Faloutsos et al. 1994, Stricker et al. 1995, Deselaers et al. 2008, Chakravarti et al. 2009 and Smeulders et al. 2000]. Retrieving an images based on the colors technique is widely used because it does not depend on image size or orientation. The most common method to create a colour histogram is by splitting the range of the RGB intensity values into equal-sized bins. For example, a 24-bit RGB colour space contains 224 possible (RGB) values. Since this gives us approximately 16.8 million bins, it will be too large to be dealt with efficiently. Therefore, we need to quantize the feature space to a smaller number in order to reduce memory size and processing time; as examples [Stricker et al. 1995, Swain et al. 1991] have proposed techniques for colour space quantization. After having defined the bins, the numbers of pixels from the image that fall into each bin are counted. A colour histogram can be used to define the different distributions of RGB intensity values for a whole image, known as a global colour histogram, and for specific regions of an image, known as a local colour histogram. For a local colour histogram, the image is divided into several regions and a colour histogram is created for each region. A histogram refinement strategy has been proposed by Pass for comparing the images [Pass et al.1996]. Histogram refinement splits the pixels in a given bucket into several classes, based upon some local property. Within a given bucket, only pixels in the same class are compared. They describe a split histogram called a color coherence vector (CCV), which partitions each histogram bucket based on spatial coherence. [Han et al. 2002] proposed a new color histogram representation, called fuzzy color histogram (FCH), by considering the color similarity of each pixels color associated to all the histogram bins through fuzzy-set membership function. This approach is proves very fast and is further exploited in the application of image indexing and retrieval. The paradigm of the color histogram works on the assumption that all the images or videos frames with the similar color composition are similar [Jain et al. 1995]. It will retrieve all the data whose color composition is similar to the given query. This will be true in some cases. Color composition cant be the identity of the image or object inside the image. Color Moment: Color moment approach was proposed by [Stricker et al. 1995]. It is a very compact representation of color feature. The mathematical meaning of this approach is that any color distribution can be characterized by its moments. Moreover, most of the information is concentrated on the low-order moments, only the first moment, second and third central moments (mean, variance and skewness) were extracted as the color feature representation. Color similarity can be measured by Weighted Euclidean distance. Due to the ease and sound performance of color histogram technique it is widely used in color based retrieval systems. Color is the human visual perceptual property. Human discriminate an images or objects initially on the basis of colors. Color can be extracted from the digital data easily and automated and effective functions are available for calculating the similarity between the query and the data corpus. Color feature are effectively used for indexing and searching of color images in corpus. The existing CBIR techniques can typically be categorized on the basis of the feature it used for the retrieval i.e. color, shape, texture or combination of them. Color is an extensively utilized visual attribute that plays a vital role in retrieving the similar images [Low et al. 1998]. It has been observed that even though color plays a crucial role in image retrieval, when combined with other visual attributes it would yield much better results [Hsu et al. 1995]. This is because, two images with entirely similar color compositions, may have different color composition and sometimes two images have same color composition but they are not similar as shown in the figure. Hence something that looks similar is not semantically similar. The color composition of both the images in figure 11 is same but they depict the entirely different semantic idea. By analyzing both the images using the color based retrieval techniques both the images are similar
